Acceptable Use Policy
Inappropriate
Behavior
Wireless
Internet for Central Oregon (WIN4CO) reserves the right to refuse
service to any person for inappropriate behavior. Our Customers
agree to follow these policies regarding Internet use. Currently
these policies prohibit but are not limited to:
- Any use,
which violates any applicable local, state, or federal law of
the United States of America, including but not limited to
copyright, trade secret, or criminal laws, is strictly
prohibited.
- System
abuse is strictly prohibited. Wireless Internet for Central
Oregon (WIN4CO) may terminate or modify service immediately and
may bill for any resulting support charges if the client engages
in system abuse. Following is a list of actions that are defined
to be system abuse. This list is non-exclusive; any action about
which there is any doubt should be referred to Wireless Internet
for Central Oregon (WIN4CO) for evaluation.
3.
Actions that constitute system abuse include, but are not limited
to:

Attempting to circumvent user authentication or security of
any host, network, or account on Wireless Internet for
Central Oregon (WIN4CO) systems or the Internet at large
("cracking");

Attempting, in any way, to interfere with or deny service to
any user or any host on the Internet;
- Forging
email or USENET posting header information;
- Sending
large numbers of unsolicited mail messages (i.e. "junk
mail"); this includes adding or attempting to add addresses
to any mailing list without explicit positive consent of the
addressee.

Forwarding or posting "chain letters" (multiple forwarding)
of any type;
- Posting
inappropriate messages to USENET newsgroups e.g., posting
large numbers of unsolicited posts indiscriminately
("spamming"), or posting encoded binary files to USENET
newsgroups not specifically named for that purpose;

Attempting to cancel, supersede, or otherwise interfere with
email or USENET posts other than one's own;

Engaging in harassment, whether through language, frequency,
or size of messages;
- Using
an account at another provider to promote a Wireless
Internet for Central Oregon (WIN4CO) Web site in an abusive
manner;
- Using a
Wireless Internet for Central Oregon (WIN4CO) account or
network connection to collect replies to messages sent from
another provider which violate these rules or those of that
provider;
- Use of
an auto-redialer to reconnect an unattended connection;
- Use of
pinging software to maintain an unattended connection;

Reselling Wireless Internet for Central Oregon (WIN4CO)
services to third parties who do not abide by these
guidelines.
4.
Any use to make unauthorized entry to other computers, computer
information, or communication devices or resources is strictly
prohibited.
5.
Uploading files without the consent of the copyright or patent owner
is strictly prohibited.
6.
Should any action by any Customer in violation of these limitations
or policies result in a disruption or interference with Wireless
Internet for Central Oregon (WIN4CO) network operation, the Customer
will be disconnected from further service without notice and will be
completely liable for all charges and fees resulting from these
violations.
Payments, Fees, Cancellations, Collections
Currently these policies require but are not limited to:
- Payment in
advance is required for all plans and is due by the 1st of every
month for the upcoming period of service. All sales are in
monthly increments. Failure to receive
a bill or invoice does not relieve you of the responsibility to
pay on time.
- There are
no free trial periods. Accounts choosing check paying method
must make a cash (check or money order) payment at the local
Redmond WIN4CO office at 1810 SE 1st Street, Suite K,
Redmond, OR 97756 within seven days of signup for services.
- Accounts
choosing direct withdrawal from their bank or credit card authorize WIN4CO to
deduct the appropriate monthly fee from their account
and commit to maintaining a balance sufficient to cover all
withdrawals.
- All
accounts that are 5 days late on their payments will be put on
hold (denied access) until full payment is received. In the case
of returned checks WIN4CO reserves the right to wait until the
new check clears the customers bank before restoring service.
- All
accounts that are 30 days late on their payments will be deleted
from the WIN4CO server and the records sent to collection and
credit agencies.
- If a
payment for any monthly or annual plan is 30 days or more past
due, the payment will be applied to all outstanding balances and
late fees first. The standard monthly rate in effect will be
applied on all late payments first, then the late fees. Any
remaining balance will be applied towards the next month's
payment at the standard monthly rate.
- FEES
SCHEDULE:
A $15.00 fee will be assessed all accounts 5 days past due on
their accounts.
A $25.00 fee will be assessed for returned checks.
A $10.00 fee will be assessed for declined credit card payments.
A $25.00 reconnect fee will be assessed for all accounts placed on hold
for nonpayment or inappropriate behavior
A $50.00 fee will be assessed on all accounts sent to
collection.
- Wireless
Internet for Central Oregon (WIN4CO) may change any fee, rate,
or package at any time without notice.
- Customers
wishing to cancel accounts must email or write the local
Wireless Internet for Central Oregon office of that intention.
There is no other reliable way to cancel a WIN4CO account.
- The
local Redmond WIN4CO office is located at 1810 SE 1st
Street, Suite K, Redmond, OR 97756.
- Email
can be sent to
info@win4co.com.
- The
customer is encouraged to keep a copy of their cancellation
letter or email as proof of cancellation request.

Customers attempting to cancel by phone should be aware that
there may be no proof of cancellation available to them.

Customers attempting to cancel by returning their billing
notice to our billing department with cancel written on it
should be aware that this process is very unreliable and
does not constitute proof of cancellation. The customer
must email or write the local WIN4CO office.
- Monthly
accounts automatically renew and charges are automatically
due for the next month unless the Wireless Internet for
Central Oregon (WIN4CO) local office is notified by email or
letter of customer's intent to cancel.
- The
entire month's service is purchased no matter when during
the month the customer cancels.
- DNS
switch requests can only be accomplished by a signed,
written request by the owner of the domain on proper company
letterhead.
- Upon
cancellation of an account by a customer, all unpaid charges are
immediately due and payable. An account that is deleted from
our system with current charges unpaid is immediately sent to
collection. It is the customer's responsibility to avoid the
collection process by paying, immediately upon cancellation, all
unpaid charges incurred, including all late fees, returned check
charges and credit card decline fees.
- Charges
will continue to accrue until all unpaid fees are paid or
account is sent to collection.
- Wireless
Internet for Central Oregon (WIN4CO) uses a two-tier collections
process. Tier one involves sending notices of past due to the
customer's last known address. If we do not get a response from
the overdue account it moves to tier-two, which involves an
extended effort to contact the customer by phone. When an
account moves to tier two collections, Wireless Internet for
Central Oregon (WIN4CO) reserves the right to double the amount
due and assign the account to the collections agency to
prosecute in small claims court.
- In the case
of domain name hosting, Wireless Internet for Central Oregon
(WIN4CO) reserves the right to withhold transfer of the domain
to another ISP if the accumulated fees for that site have not
been paid in full. Additionally, if fees are outstanding more
than 5 days Wireless Internet for Central Oregon (WIN4CO)
reserves the right to disable that site and display on that site
the reason for disablement as non payment of hosting fees.
- Requests
for transfer of DNS to a non-WIN4CO service require written
authorization by the Wireless Internet for Central Oregon
(WIN4CO) owner of record. Wireless Internet for Central Oregon
(WIN4CO) strictly limits its involvement in transfer of DNS to
non WIN4CO services to replying either positively or negatively
to the request for DNS transfer.
- Wireless
Internet for Central Oregon (WIN4CO) has every intention to keep
all aspects of Customer accounts private, but it is impossible
for Wireless Internet for Central Oregon (WIN4CO) to guarantee
that any activity done while using it's service will be
completely private. Customers can increase their level of
privacy by using data encryption. Privacy is not guaranteed.
Customers are responsible for their Internet accounts. Change
your password often to enhance security and prevent unauthorized
use of your account.
- Customers
under 18 years of age may not apply for this service without
parental approval.
- Customers
specifically agree to defend, indemnify, and hold harmless
Wireless Internet for Central Oregon (WIN4CO) , it's agents,
officers, directors, employees, successors, and assignees, from
any claim, loss, or damage, including costs and attorney fees,
arising out of or related to any act of omission of the Customer
under this agreement, including without limitation the Customers
causation of such damages or injury, directly or indirectly, to
any party.
Denial of Access to an Account
Reasons for denying a customer access to their account (account is
on hold) and/or disabling their domain hosting site include but are
not limited to: (hosting sites disabled for non payment of hosting
fees will have a sign to that effect displayed on their site until
fees are paid)
1.
Method of payment is check pay and no
payment has been received 5 days after the due date.
2.
Account is a new sign up on billing
method of payment and no payment has been received at the local
WIN4CO office by the seventh day after activation.
3.
Method of payment is credit or debit
card and card is declined, rejected or bad account number.
4.
Method of payment is check pay and
check is returned NSF (insufficient funds) or account closed.
5.
Account has been implicated in
spamming or other illegal activities.
6.
Customer representing account has
demonstrated obnoxious or abusive behavior towards other Internet
customers, WIN4CO employees or services hired by WIN4CO.
7.
Customer has been reselling broadband
service.
Troubleshooting Limitations
When
a customer calls WIN4CO offices for help with their computer
configuration it is assumed by WIN4CO personnel:
1.
The customer assumes all liability
for the outcome of all troubleshooting activity.
2.
All software and hardware involved is
owned by and is the responsibility of the customer.
3.
WIN4CO employees will try and help
the customer but they are not experts in all software/hardware
combinations and are merely helping at the sole request of the
customer.
4.
WIN4CO takes extreme precautions to
ensure the quality of any software distributed on write-able media
(diskettes. Write-able CD ROM, etc) including virus scanning using
current Anti-Virus software with the latest virus update files.
However, once software on write-able media leaves WIN4CO offices,
WIN4CO no longer has control of that software and the customer
assumes full responsibility for Quality Control, including virus
scanning, prior to using the software.
5.
WIN4CO does not produce any software
for direct customer consumption and assumes no responsibility for
the accurate working of any third party software.
6.
WIN4CO sells only connectivity to the
Internet and web site hosting. The correct concern of
troubleshooting by WIN4CO employees is limited to connection of the
customer to the Internet or web site hosting.
7.
Customers who load files to their
web sites or the web space associated with their virtual domain, are
advised to keep a current copy of those files locally on a non
dynamic (static) medium such as diskettes, Zip disks, CD-ROM etc.
WIN4CO does not make backup copies of customer files and our
technical staff will need the customer’s files in the event they are
erased or corrupted on the server.
8.
It is the customer's responsibility
to monitor the amount of disk space being used on their WIN4CO
account. Results both in web site function and email function can be
unpredictable if space limits are exceeded. The customer should set
their email client to delete messages from the server after a
certain number of days. Since the size of email messages received
and the amount of disk space reserved varies widely from customer to
customer, it is the customer's responsibility to set the time limit
to delete old email to the appropriate level.
9.
The 'always on' nature of WIN4CO's
DSL (Digital Subscriber Line) communications service and Wireless
Internet requires extra caution by the customer to prevent computer
hacking attempts on their computer software. All customers are also
urged to shut down their computers when not in use to limit the time
their computers are exposed on the Internet.
Virus Control Policy
1.
We scan all of our local machines 100% of the time when uploading or
modifying any web server or related files. No machine that is in
contact with our servers with administrative capability goes
un-scanned.
2.
We also educate, inform and alert employees who then educate, inform
and alert their customers about basic virus protection and any new
viruses which may appear on the internet or otherwise, with
instructions on how to find more information and any possible
procedures to remove viruses from machines that are already
infected.
Agreement Conditions
1.
The laws of the state of Oregon shall
control this agreement. Oregon courts shall have jurisdiction over
this agreement, and all litigation hereunder shall, be tried in the
state of Oregon.
2.
This agreement shall continue from
billing period to billing period until terminated as provided
herein.
3.
Wireless Internet for Central Oregon
(WIN4CO) may suspend service of any account at any time, for any or
no reason, upon notice. No notice shall be required in the event of
non-payment or violation of these provisions.
4.
Customers may terminate this
agreement upon notification of Wireless Internet for Central Oregon
(WIN4CO). Termination will only be at the Customers request if the
Customer is not under the age of 18. Legal Guardians of Customers
under the age of 18 may terminate the account of Customers under 18.
Notification must be made by mail, email or in person to the local
Redmond WIN4CO office only. We encourage Customers to keep a copy
of their written cancellation request as proof of cancellation.
Accounts cannot be cancelled in any other manner.
5.
All amounts, including late fees,
credit (debit) card fees, check return fees and collection fees, of
accounts terminated for non-payment or illegal activity will be sent
to a collection agency for collection and to credit history firms
for recording as bad debt. In the event that any account is sent to
a collection agency, the Customer is liable for all collection fees
and all legal fees.
6.
The Customer understands and agrees
that the Internet is a conglomeration of on-line databases operated
by distinct entities having no business or legal relationship to
Wireless Internet for Central Oregon (WIN4CO). Wireless Internet for
Central Oregon (WIN4CO) does not have input whatsoever as to the
content of Internet data accessed via the service. Customers are
solely responsible for any value or reliance it places on
information obtained via the Internet or this service. Information
derived as a result of this agreement is provided "AS IS" and at the
Customers own risk.
7.
The only warranty from Wireless
Internet for Central Oregon (WIN4CO), which is subject to the terms
and conditions of this agreement, is to provide Customers with
access to the Internet, email, and Internet website hosting.
Wireless Internet for Central Oregon (WIN4CO) make no other
warranties, either express or implied.
8.
The Customer specifically agrees
that, in no event, shall any liability accrue to Wireless Internet
for Central Oregon (WIN4CO) as a result of this agreement in excess
of the Customer's monthly fee of any single month during which any
claim of liability arose. The Customer agrees that the American
Arbitration Association will mediate all claims of liability.
9.
Upon request Wireless Internet for
Central Oregon (WIN4CO) may provide software for basic Internet
access. Wireless Internet for Central Oregon (WIN4CO) may make
suggestions about other useful software to use with a Customer's
Internet service. Other companies develop the software. Wireless
Internet for Central Oregon (WIN4CO) may not be held liable for the
use of any such software. All such use is at the discretion of the
Customer and is without warranty, either express or implied by
Wireless Internet for Central Oregon (WIN4CO).
10.
All stated upload and download speeds
are maximums. The unique dynamics of the Internet and Wireless
Internet can cause variation in speeds which can be affected by many
uncontrollable factors, such as weather, smoke, internet traffic,
etc. We will endeavor to maintain the highest possible transfer
rates at all times.
